In this Ordinance, unless the context otherwise requires-

PART II ADMINISTRATION

PART III THE REGISTER

The Registrar shall keep a register of ships
registered or

The register shall contain such particulars in respect of
ships,

charterers,
gagees and representative persons as are prescribed.
The register may be kept in legible or non-legible form but if
kept in
legible form any entry in the register shall be capable of
being

For the purposes of this section-
there is a material error in the register if there is an error
of fact

without limiting the generality of paragraph (a), there is a

there is an error or defect in an entry in the register; and

register but is not entered in, or is removed from, the register.
The jurisdiction of the High Court under this section may be

PART IV REGISTRATION OF SHIPS

Subject to this Ordinance, a ship is registrable if-
a majority interest in the ship is owned by one or more
qualified

安徽省第十届人民代表大会常务委员会第三十五次会议审查了《淮南市城市供水用水管理条例》,决定予以批准,由淮南市人民代表大会常务委员会公布施行。
淮南市城市供水用水管理条例

第一条 为了规范城市供水、用水管理,保障城市生活、生产用水,保证供水安全,维护供水、用水双方的合法权益,根据国务院《城市供水条例》和有关法律、法规的规定,结合本市实际,制定本条例。
第二条 本条例适用于本市行政区域内的城市供水、城市用水和对其实施监督管理的活动。
本条例所称城市供水,是指供水企业利用公共供水设施向用水单位和个人(以下统称用户)提供生产、生活和其他用水的行为。
本条例所称城市用水,是指用户根据生产、生活等需要使用城市供水的行为。
第三条 公用事业行政主管部门负责城市供水、用水监督管理工作。
规划、建设、环境保护、水、卫生、价格、质量技术监督、房地产等有关行政主管部门按照各自职责,负责供水、用水监督管理的相关工作。
第四条 市、县人民政府应当将城市供水事业纳入国民经济和社会发展计划,并组织有关部门编制城市供水发展规划,纳入城市总体规划。
公用事业行政主管部门应当根据城市供水发展规划,制定城市供水工程年度建设计划。
第五条 城市供水依法实行特许经营。
公用事业行政主管部门会同有关部门按照《淮南市公用事业特许经营条例》的规定,提出实行特许经营的城市公共供水项目,拟订具体实施方案,经市人民政府批准后施行。
第六条 新建、改建、扩建城市供水工程,应当符合城市供水发展规划及城市供水工程年度建设计划,按基本建设程序办理。
城市供水工程竣工后,建设单位应当组织有关单位验收。未经验收或验收不合格的,不得交付使用。
城市供水工程自竣工验收合格之日起15日内,建设单位应当将工程竣工验收报告和有关行政主管部门的认可文件报公用事业行政主管部门备案。
第七条 在城市公共供水管网覆盖区域内,供水能力能够满足需要的,不得新建设施取用地下水。已建成的以地下水为水源的取水设施,应当依法限期关停。
第八条 用水单位自行投资建设的与城市公共供水管道连接的管道及其附属设施,必须符合供水工程技术标准。设计前应当向城市公共供水企业提出用水申请,管道及其附属设施的设计方案应当征求城市公共供水企业的意见;竣工后由城市公共供水企业验收合格后并交其统一管理,方可与公共供水管网连接使用,并将工程竣工资料报送城市公共供水企业。
第九条 因工程建设确需改装、拆除或者迁移城市公共供水设施的,建设单位应当将工程改造和应急供水方案等报送公用事业行政主管部门批准,并按批准的方案采取相应补救措施。
公用事业行政主管部门应当自受理建设单位申请之日起15个工作日内予以书面答复。
第十条 自建设施的供水管网或者内部用水系统不得擅自与城市公共供水管网连接;因特殊情况确需连接时,应当经城市供水企业同意,报公用事业行政主管部门和卫生行政主管部门批准,经试压、冲洗、消毒后方可连接。
生产或者使用有毒、有害物质的单位不得将其生产用水管网及附属设施直接与城市公共供水管网连接。
第十一条 住宅用水应当实行一户一表、水表出户、抄收到户。
已建住宅未装分户计量水表的,由公用事业行政主管部门责令有关单位限期改造。经验收合格后,移交供水企业。
第十二条 供水企业应当建立水质管理制度,定期检测水质,确保水质符合国家标准;自检能力达不到国家规定的,应当委托法定检测机构检测。
卫生、公用事业行政主管部门应当按照各自的职责对城市供水全过程进行水质监测、监督和检查,并按照规定定期将水质检测结果向社会公布。
水质检测不合格的,由公用事业行政主管部门责令停止供水并限期改正,确保用水安全。停水期间,公用事业行政主管部门应当采取措施解决居民基本生活用水。
第十三条 二次供水设施管理单位应当建立健全二次供水水质和供水设施运行、清洗、消毒及安全保障管理制度,每半年至少对储水设施进行一次清洗消毒,确保水质符合国家标准;不能对水质进行常规检测的,应当委托法定检测机构检测。
第十四条 供水企业和二次供水单位应当保持连续供水,不得限时供水,并保障水压符合国家标准。
因工程施工、供水设施维修等原因需要停止供水的,应当经公用事业行政主管部门批准,并提前24小时通知用户;通知时间另有约定的,从其约定。暂停或降压供水应当错开用水高峰期。因发生事故等情况而临时停止供水的,应当在抢修的同时通知用户,并报告公用事业行政主管部门。
城市供水设施维修时,有关单位和个人应当给予配合。
第十五条 公用事业行政主管部门、供水企业应当制定突发事件应急预案。因自然灾害、突发事故等特殊原因影响正常供水时, 公用事业行政主管部门、供水企业应当及时通知用户,并立即启动应急预案,采取应急供水措施,保障居民基本生活用水。
第十六条 城市用水实行分类水价。城市用水按用水性质分为居民生活用水、工业用水、行政事业用水、经营服务用水和特种用水等。
同一用户不同类别的用水应当分表计量,由于用户原因不能分表计量的,按照相应的最高类别适用水价;由于供水企业的原因不能分表计量的,按照相应的最低类别适用水价。双方有争议的,可以协商解决;协商不成,按照合同法的有关规定处理。
第十七条 供水企业应当履行普遍服务的义务,在供水管网覆盖区域内,对符合城市规划且具备接水条件的用水申请应当受理。用水申请包括申请人名称、地址、用水性质、月用水量、耗水状况、节水措施等内容。
供水企业应当自收到用水申请之日起5日内确定用水性质,并书面告知申请人。
申请人对用水性质认定有异议的,可以向公用事业行政主管部门提出书面异议申请。公用事业行政主管部门应当在5个工作日内答复;用水性质认定有误的,责令供水企业改正,并书面告知申请人。
第十八条 供水价格和建安、改造费用标准的制定和调整,依照价格法律、法规的规定执行。供水企业应当按照依法核定的标准收取费用。
第十九条 供水企业应当与用户依法订立供用水合同,约定双方的权利、义务和违约责任。
第二十条 用户应当按时缴付水费,逾期未缴付的,供水企业应当发出限期1个月内缴付的通知;逾期仍未缴付的,供水企业可以按合同约定暂停供水,收取违约金。用户缴清欠费后,供水企业应当在18小时内恢复供水。
因用户责任造成水表损坏不能计量的,当月水费按前3个月中的最高月用水量计收水费;非用户责任的,按前3个月平均用水量计收。
用户迁出、迁入、分户、并户、要求停止供水或改变用水性质的,应当到供水企业办理相关手续,并结清水费。
第二十一条 用户对水表准确度有异议的,可以向法定检测机构申请检测。计量误差超过规定标准的,供水企业应当承担检测费用,并免费更换水表,退还多收的水费;计量误差符合规定标准的,用户承担检测费用。
第二十二条 禁止下列用水行为:
(一)非法取用消防用水;
(二)擅自在城市公共供水管道上取水;
(三)擅自改变用水性质;
(四)故意损坏水表和擅自更换水表;
(五)利用各种形式转供水;
(六)其他盗用公共供水行为。
第二十三条 公共供水设施穿越沟渠、河床、堤坝,应当于所在位置设立明显标志,划定安全保护区。
工程施工中发现城市公共供水管网的,应当停止施工,及时告知供水企业。经采取有效保护措施后,方可继续施工。
第二十四条 供水企业应当安装使用经法定检测机构检测合格的计量水表,并按照规定维护、检测、更换及承担相关费用。用户发现水表损坏的,应当及时报告供水企业;供水企业应当及时维修、更换。
住宅供水设施的维护管理,水表出户的,户外部分由供水企业负责,户内部分由用户负责;水表未出户的,水表之前部分由供水企业负责,水表之后部分由用户负责。
市政、园林、环卫、绿化等公共专用供水设施,由使用单位负责维护管理。
第二十五条 禁止下列损害城市公共供水设施、危害城市供水安全的行为:
(一)在城市公共供水设施安全保护区内,进行挖掘作业、取土、采砂、植树、建造建筑物或构筑物、倾倒垃圾、堆放杂物等;
(二)擅自启闭管网阀门或者损毁、盗窃、压占公共供水设施;
(三)擅自将供暖或其他管网与城市公共供水管网连接;
(四)其他损害城市公共供水设施、危害城市供水安全的行为。
第二十六条 二次供水工程设计方案应当征求城市供水企业的意见。工程竣工后,建设单位应当组织供水企业参与验收。验收合格方可投入使用。
鼓励城市供水企业对二次供水实行全程服务和管理,并计量抄收到户。
第二十七条 二次供水设施运行、维护费用可以计入物业管理服务费,也可以在水价外单列。具体办法由价格主管部门会同有关部门按照有关法律、法规制订。
第二十八条 供水企业违反特许经营规定的,由公用事业行政主管部门按照《淮南市公用事业特许经营条例》进行处罚。
第二十九条 违反本条例第六条规定,兴建城市供水工程不符合城市供水发展规划及其年度建设计划的,由公用事业行政主管部门责令停止违法行为,可以处5万元以上20万元以下的罚款。
第三十条 违反本条例第九条规定,擅自改装、拆除或者迁移城市供水设施的,由公用事业行政主管部门责令限期改正,可以处1万元以上5万元以下的罚款;造成设施损坏的,依法承担赔偿责任。
第三十一条 违反本条例第十条规定,擅自将自建设施供水管网系统与城市公共供水管网系统直接连接的,由公用事业行政主管部门责令其限期改正,可以处1万元以上5万元以下的罚款;造成水质污染的,依法承担赔偿责任;构成犯罪的,依法追究刑事责任。
第三十二条 违反本条例第十三条规定,未按要求对二次供水储水设施进行清洗消毒的,由公用事业行政主管部门责令改正,可以处1000元以上1万元以下的罚款。
第三十三条 违反本条例第十四条规定,供水企业和二次供水单位限时供水的,由公用事业行政主管部门责令限期改正;逾期未改正的,可以处2万元以上10万元以下的罚款。
第三十四条 供水企业和二次供水单位有下列行为之一的,由公用事业行政主管部门责令改正,可以处2万元以上10万元以下的罚款。造成用户损失的,依照合同约定或法律规定承担相应的民事责任:
(一)供水水质、水压不符合国家规定标准的;
(二)擅自停止供水或未履行停水通知义务的;
(三)未按规定检修供水设施或者在供水设施发生故障后未及时抢修的。
第三十五条 违反本条例规定,非法取用消防用水、擅自在城市公共供水管道上取水或采用其他形式盗用城市公共供水的,由公用事业行政主管部门责令限期改正,按其用水性质和用水量补交水费,并可以处应交水费3倍的罚款;用水量无法计算的,按最高日用水量确定。
利用各种形式转供水的,由公用事业行政主管部门责令限期改正,按其实际用水性质补交水费,并可处以补交水费3倍的罚款。
第三十六条 违反本条例第二十五条第一项、第二项、第三项规定,损害城市公共供水设施、危害城市供水安全的,由公用事业行政主管部门责令改正,可以处5000元以上1万元以下的罚款;造成损失的,依法承担赔偿责任;构成犯罪的,依法追究刑事责任。
第三十七条 违反本条例规定,供水工程或二次供水设施竣工未经验收或验收不合格投入使用的,由公用事业行政主管部门责令改正;造成损失的,依法承担赔偿责任。
第三十八条 公用事业行政主管部门等有关行政部门及其工作人员玩忽职守、滥用职权、徇私舞弊的,依法给予行政处分;构成犯罪的,依法追究刑事责任。
第三十九条 本条例自2008年2 月1 日起施行。
